§ 2 Geltungsbereich
Diese Allgemeinen Geschäftsbedingungen (nachfolgend: AGBs) gelten für alle Rechtsgeschäfte zwischen dem Verwender (S. § 1) und einem Verbraucher: eine Verbraucherin/ein Verbraucher ist eine Person (Kunde), die ein Rechtsgeschäft abschließt, d.h. eine Willenserklärung über einen Tatbestand abgibt, die weder ihrer beruflichen noch gewerblichen Tätigkeit zugerechnet werden kann.
Diese Allgemeinen Geschäftsbedingungen und alle auf ihrer Grundlage abgeschlossenen Verträge unterliegen österreichischem Recht. Siehe Allgemeines bürgerliches Gesetzbuch (ABGB) und Konsumentenschutzgesetz (KSchG).
§ 3 Vertragsschluss und Speicherung des Vertragstextes
Die Bestimmungen dieser AGBs gelten für alle Bestellungen, welche Verbraucher (siehe § 2) über das Online-Shop von Veselina Zagralova (www.vesselinazagralova.com/shop) abschließen.
Der Vertrag kommt mit dem Verwender (siehe § 1) zustande.
Die Vorstellung, Darstellung und Beschreibung der Waren auf der Internetseite des Online-Shops von Veselina Zagralova (www.vesselinazagralova.com/shop) stellt kein Vertragsangebot dar.
Die ausgewählten Produkte mit dem Button „In den Warenkorb“ werden zum Abschluss des Bestellprozesses noch einmal in einer Bestellübersicht zusammengefasst. Hier können Sie noch einmal die angegebenen Angaben/Bestellungen überprüfen bzw. ändern.
Mit dem Klick auf den Button „Jetzt Bezahlen“ am Ende des Bestellvorgangs geben Sie ein verbindliches Angebot auf einen Kaufvertragsabschluss ab und erklären sich mit den AGBs und den Datenschutzbestimmungen vom Onlineshop von Veselina Zagralova (www.vesselinazagralova.com/shop) einverstanden.
Überprüfen Sie genau Ihre Angaben, bevor Sie Ihre Bestellung an dem Verwender übertragen. Ihre Bestellung wird bei dem Verwender nicht gespeichert und kann nach Abschluss des Bestellvorgangs nicht mehr abgerufen werden.
Nach dem Zahlvorgang erhalten Sie eine Zahlungsbestätigung von PayPal. Bitte bewahren Sie diese Nachricht sorgfältig auf.
Ein Vertrag kommt mit dieser Zahlungsbestätigung noch nicht zustande.
Erst mit dem Versand einer Auftragsbestätigung per E-Mail durch den Verwender (siehe § 1) kommt der Vertragsschluss zustande. Die Auftragsbestätigung mit den Bestelldetails bekommen Sie innerhalb von 24 Stunden nach der Zahlungsbestätigung.
§ 4 Preise, Zahlung
Die im Online-Shop von Veselina Zagralova (www.vesselinazagralova.com/shop) angegebenen Preise sind Endpreise einschließlich Umsatzsteuer und eine Kostenpauschale von 10 EUR für Verpackung und Versand. Die Kunstdrucke werden ohne Bilderrahmen verkauft.
Im Shop stehen folgende Zahlungsoptionen zur Verfügung:

Sie können per PayPal sicher und schnell bezahlen. Die Bezahlung per PayPal (PayPal (Europe), S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg) erfolgt unter Geltung der PayPal-Nutzungsbedingungen, einsehbar unter https://www.paypal.com/at/webapps/mpp/ua/useragreement-full. Bei der Zahlung per PayPal entstehen für Sie keine Gebühren.
Bei Zahlung per PayPal entspricht der Zahlungszeitpunkt dem Zeitpunkt der Bestellung. Sie wird dann direkt verarbeitet. Bei Rücksendungen wird der bezahlten Betrag auf Ihr PayPal-Konto gutgeschrieben.
Kreditkarte:
Bei Zahlung per Kreditkarte entspricht der Zahlungszeitpunkt dem Zeitpunkt der Bestellung. Sie wird dann direkt verarbeitet. Bei dieser Zahlungsmethode werden Sie nach den für diese Zahlungsart erforderlichen Daten gefragt. Ihre Daten werden über eine verschlüsselte Verbindung übermittelt. Ihre Kreditkartendaten werden nicht in unseren Systemen gespeichert. Es fallen keine zusätzlichen Gebühren für Sie an.
Der Verbraucher (siehe § 2) stimmt zu, dass der Verwender (siehe § 1) berechtigt ist, die Rechnung als elektronische Rechnung (Rechnung, die in einem elektronischen Format ausgestellt und empfangen wird, z.B. als PDF-Dokument) per E-Mail an ihm zu senden.
§ 5 Lieferung, Lieferungsbeschränkungen
Die Lieferzeit beträgt – sofern die Beschreibung eines gewählten Produkts nicht explizit Abweichendes festlegt – ca. 2 Wochen. In dieser Zeit sind Produktions- und Versandzeit inkludiert. Diese Frist beginnt im Falle der Zahlung via Paypal oder Kreditkarte am Tag nach Erteilung des Zahlungsauftrages zu laufen. Der Verwender (siehe § 1) behält sich das Recht die angegebenen Zeit von ca. 2 Wochen auf Grund von Produktionsverzögerung und/oder Versand außerhalb EU zu überschreiten. Über Änderungen bzw. Verzögerungen der angegebenen Zeit von ca. 2 Wochen hat der Verwender den Verbraucher (siehe § 2) per E-Mail zu informieren.
Die Lieferung erfolgt nur im Versandweg an die angegebene Lieferadresse. Eine Selbstabholung ist nicht möglich.
Bei Lieferungen außerhalb Österreichs können zusätzlich die jeweils geltenden Aus- und Einfuhrabgaben anfallen, die der Verbraucher zu tragen haben. Der Verbraucher ist für die ordnungsgemäße Abfuhr der notwendigen Zölle und Gebühren verantwortlich.
§ 6 Gefahrenübergang
Das Risiko einer zufälligen Verschlechterung oder einem zufälligen Verlust der Ware liegt bis zur Übergabe der Ware beim Verwender (siehe § 1) und geht es mit der Übergabe auf den Verbraucher (siehe § 2) über. Als Verbraucher müssen sie Verschlechterung bzw. Verlust der Ware beim Lieferant reklamieren und sofort Kontakt mit dem Verwender aufnehmen. Wenn sie eine Reklamation oder Kontaktaufnahme versäumen, hat das für Ihre Gewährleistung keinerlei Konsequenzen.
§ 7 Eigentumsvorbehalt
Bis zum vollständigen Empfang des Kaufpreises behält sich der Verwender (siehe § 1) das Eigentum an der Ware vor.
§ 8 Gewährleistung
Die gesetzlichen Gewährleistungsregelungen gelten (Siehe ABGB). Die Gewährleistungsfrist beträgt ein Jahr ab Ablieferung des Produkts.
§ 9 Haftung
9.1. Im Zuge des Rückversands (siehe § 11 dieser AGBs) haften Sie für den Verlust oder die Beschädigung des Kunstwerks auf dem Postweg.
9.2. Für Schäden, die nicht den Kunstdruck selbst betreffen, haftet der Verwender (Siehe § 1) nur (a) bei Vorsatz oder grober Fahrlässigkeit sowie (b) bei schuldhafter Verletzung von Leben, Körper, Gesundheit. Abgesehen davon haftet der Verwender bei schuldhafter Verletzung von Vertragspflichten nur ab grober Fahrlässigkeit, wobei diese Haftung, wenn und soweit gesetzlich zulässig, auf die vertragstypischen, vernünftigerweise vorhersehbaren Schäden begrenzt ist. Die Haftung nach dem Produkthaftungsgesetz bleibt unberührt.
§ 10. Urheberrechte
Mit Bezahlung erwerben Sie das Eigentum an dem Kunstdruck, es werden aber keinerlei sonstige Nutzungsrechte an dem Produkt eingeräumt. Jegliche Vervielfältigung, Vermietung, öffentliche Zugänglichmachung oder sonstige analoge oder digitale Verwertung und Bearbeitung des erworbenen Kunstdrucks sind untersagt, soweit dies nicht gesetzlich zugelassen ist.
Der Weiterverkauf des erworbenen Produktes ist dem Verbraucher gestattet.
§ 11 Widerrufsrecht
Verbrauchern (siehe § 2) steht ein Widerrufsrecht zu.
11.1 Widerrufsbelehrung
11.1.1 Widerrufsrecht:
Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen.
Die Widerrufsfrist beträgt vierzehn Tage, ab dem Tag, an dem Sie oder ein von Ihnen benannter Dritter, der nicht der Beförderer ist, die Waren in Besitz genommen haben bzw. hat.

mittels einer schriftliche Mitteilung per E-Mail über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren. Sie können dafür das beigefügte Muster-Widerrufsformular (PDF runterladen) verwenden, das jedoch nicht vorgeschrieben ist.
11.1.2 Widerrufsfolgen
Wenn Sie diesen Vertrag widerrufen, hat der Verwender (siehe § 1) Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, zurückzuzahlen. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet.
Die Rückzahlung erfolgt erst, nachdem gekaufte Artikel erfolgreich an den Shop zurückgegeben wurden. Sie tragen die unmittelbaren Kosten der Rücksendung der Waren. Die Kunstdrucke sind in der Originalverpackung zurückzusenden und ordentlich zu verpacken.
11.2 Ersatz
Da es sich bei vielen Shop-Artikeln um Limited Editions (einzigartige Artikel) handelt, gibt es keinen Ersatz für Bestellungen. Dies schließt alle Bestellungen ein, die sich noch auf dem Transportweg befinden.
§12 Vertragssprache
Die für den Vertragsschluss zur Verfügung stehende Sprache ist Deutsch.
§ 13. Datenschutz
Ihre Daten werden vertraulich behandelt und nicht an Dritte weitergegeben, die nicht am Bestell-, Auslieferungs- und Zahlungsvorgang beteiligt sind. Mehr darüber lesen Sie in der Datenschutzerklärung.
§ 14 Kunstdruck
Im Onlineshop von Vesselina Zagralova (www.vesselinazagralova.com/shop) werden Kunstdrucke von Kunstwerken von Vesselina Zagralova in limitierten Auflagen zum Verkauf angeboten. Sobald die Auflagenzahl erschöpft ist, werden keine weiteren Kunstdrucke mit dem jeweiligen Motiv produziert. Die Kunstdrucke sind signiert und nummeriert. Jeder Kunstdruck beinhaltet 1 cm weißen Rand. Die hochwertigen Kunstdrucke werden in Wien produziert.

§ 2 Scope
These General Terms and Conditions (hereinafter: GTCs) apply to all legal transactions between the User (p. § 1) and a consumer: a consumer is a person (customer) who enters into a legal transaction, i.e. makes a declaration of intent regarding a fact that cannot be attributed to his/her professional or commercial activity.
These General Terms and Conditions and all contracts concluded on their basis are subject to Austrian law. See General Civil Code (ABGB) and Consumer Protection Act (KSchG).
§ 3 Conclusion of contract and storage of the contract text
The provisions of these GTCs apply to all orders that consumers (see § 2) conclude via the online store of Veselina Zagralova (www.vesselinazagralova.com/shop).
The contract is concluded with the user (see § 1).
The presentation, display and description of the goods on the website of the online store of Veselina Zagralova (www.vesselinazagralova.com/shop) does not constitute a contract offer.
The selected products with the button „Add to cart“ are summarized once again in an order overview at the end of the ordering process. Here you can once again check or change the specified information / orders.
By clicking on the button „Pay now“ at the end of the ordering process, you make a binding offer to conclude a purchase contract and agree to the terms and conditions and the privacy policy of the online store of Veselina Zagralova (www.vesselinazagralova.com/shop).
Please check your data carefully before submitting your order to the user. Your order will not be stored by the user and cannot be retrieved after the order process is completed.
After the payment process you will receive a payment confirmation from PayPal. Please keep this message carefully.

Only with the dispatch of an order confirmation by e-mail by the user (see § 1) the contract is concluded. You will receive the order confirmation with the order details within 24 hours after the payment confirmation.
§ 4 Prices, Payment
The prices stated in the online store of Veselina Zagralova (www.vesselinazagralova.com/shop) are final prices including VAT and a flat rate of 10 EUR for packaging and shipping. The art prints are sold without picture frames.

When paying by PayPal, the time of payment corresponds to the time of the order. It will then be processed directly. For returns, the amount paid will be credited to your PayPal account.

When paying by credit card, the time of payment corresponds to the time of the order. It will then be processed directly. With this payment method, you will be asked for the data required for this payment method. Your data will be transmitted via an encrypted connection. Your credit card data will not be stored in our systems. There are no additional fees for you.
The consumer (see § 2) agrees that the user (see § 1) is entitled to send the invoice as an electronic invoice (invoice issued and received in an electronic format, e.g. as a PDF document) to him by e-mail.
§ 5 Delivery, delivery restrictions
The delivery time is - unless the description of a selected product explicitly states otherwise - approximately 2 weeks. This time includes production and shipping time. In the case of payment via Paypal or credit card, this period begins to run on the day after the payment order is issued. The user (see § 1) reserves the right to exceed the specified time of about 2 weeks due to production delays and / or shipping outside the EU. The user has to inform the consumer (see § 2) about changes or delays of the indicated time of approx. 2 weeks by e-mail.
Delivery will be made only by mail order to the specified delivery address. A self-collection is not possible.
In the case of deliveries outside Austria, the applicable export and import duties may also be incurred, which shall be borne by the consumer. The consumer is responsible for the proper removal of the necessary customs duties and fees.
§ 6 Transfer of risk
The risk of accidental deterioration or accidental loss of the goods shall remain with the user until the goods are handed over (see § 1) and it shall pass to the consumer (see § 2) upon handover. As a consumer, you must claim deterioration or loss of the goods to the supplier and immediately contact the user. If you fail to make a complaint or contact the supplier, this will have no consequences for your warranty.
§ 7 Retention of title
Until the complete receipt of the purchase price, the user (see § 1) retains ownership of the goods.
§ 8 Warranty
The legal warranty regulations apply (see ABGB). The warranty period is one year from delivery of the product.
§ 9 Liability
9.1 In the course of the return shipment (see § 11 of these GTCs) you are liable for the loss or damage of the artwork in transit.
9.2. The User (see § 1) is only liable for damages that do not concern the art print itself (a) in case of intent or gross negligence and (b) in case of culpable injury to life, body, health. Apart from this, the User shall only be liable in the event of culpable breach of contractual obligations in the event of gross negligence, whereby this liability shall be limited, if and to the extent permitted by law, to the reasonably foreseeable damage typical of the contract. Liability under the Product Liability Act remains unaffected.
§ 10. Copyrights
With payment you acquire ownership of the art print, but no other rights to use the product are granted. Any duplication, renting, making available to the public or other analog or digital utilization and processing of the purchased art print is prohibited, unless permitted by law.
The resale of the purchased product is permitted to the consumer.
§ 11 Right of cancellation
Consumers (see § 2) are entitled to a right of revocation.
11.1 Cancellation policy
11.1.1 Right of cancellation:
You have the right to revoke this contract within fourteen days without giving any reason.
The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.

by means of a written notice by e-mail of your decision to revoke this contract. You can use the attached sample cancellation form (PDF download) for this purpose, but it is not mandatory.
11.1.2 Consequences of revocation
If you revoke this contract, the user (see § 1) shall refund to you all payments we have received from you. For this repayment, we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment.
The repayment will only be made after purchased items have been successfully returned to the store. You will bear the direct costs of returning the goods. Art prints must be returned in their original packaging and neatly packed.
11.2 Replacement
Since many store items are limited editions (unique items), there are no replacements for orders. This includes all orders that are still in transit.
§12 Contract language
The language available for the conclusion of the contract is German.
§ 13. Data protection
Your data will be treated confidentially and will not be passed on to third parties who are not involved in the ordering, delivery and payment process. You can read more about this in my Privacy Policy.
§ 14 Art print
In the online store of Vesselina Zagralova (www.vesselinazagralova.com/shop) art prints of artworks by Vesselina Zagralova are offered for sale in limited editions. Once the number of editions is exhausted, no further art prints with the respective motif are produced. The art prints are signed and numbered. Each art print includes 1 cm white border. The high quality art prints are produced in Vienna.
